Conveyancing

Legal help buying or selling property in New South Wales, from the contract through to settlement.

Buying or selling property is one of the biggest financial decisions most people make, and the paperwork can be hard to follow. Alzaim Keane Legal can look after the legal work from start to finish, so you know what you are signing, what happens next and when you need to act.

Speak to us before you sign anything. It is far easier to raise a concern with a contract before it becomes binding.

Buying a property

  • Reviewing the contract and explaining it in plain English before you sign
  • Checking the title and searches for anything that affects the property
  • Advising on cooling-off rights and the deposit
  • Working with your lender and the seller's legal representative
  • Calculating settlement adjustments for rates and water
  • Advising on transfer duty and preparing the transfer documents
  • Attending to settlement so the property passes into your name

Selling a property

  • Preparing the contract for sale before your property goes on the market
  • Arranging the certificates and documents the contract needs
  • Responding to enquiries and requests from the buyer's representative
  • Liaising with your lender to discharge any existing mortgage
  • Preparing the settlement figures
  • Attending to settlement so you receive the sale proceeds

How the process works

  1. Contract

The seller's contract is prepared and the buyer has it reviewed. Terms can be negotiated at this stage.

  2. Exchange

Each party signs a copy of the contract and the copies are swapped. The buyer pays the deposit and the agreement becomes binding.

  3. Before settlement

Finance is finalised, searches and enquiries are completed, and the settlement figures are prepared.

  4. Settlement

The balance of the price is paid, any mortgage is discharged and ownership passes to the buyer.

Good to know in NSW

  • Buyers of residential property generally have a cooling-off period of 5 business days after exchange. Off-the-plan contracts have 10 business days.
  • A buyer who withdraws during the cooling-off period must pay the seller 0.25% of the purchase price.
  • There is no cooling-off period when you buy at auction, or when you exchange on the same day after a property is passed in.
  • A seller must have a contract prepared by a lawyer or licensed conveyancer before a residential property is marketed.
